Who's the thief?

At 10 P.M. lastnight someone cut the power to an apartment complex and stole some jewlries. The cop took 5 men in for questioning. They believe that one of those 5 is the thief. One by one they ask the same question. The question is, "Where were you at 10 p.m. lastnight?" After they answer this question, the cop already know who the thief is. Below is what their answers.

1. first person's answer: "at 10 pm, I was in the bathroom taking a shower."

2. second person's answer: "at 10 pm I was watching T.V."

3. third person's answer: "at 10 pm, I was making love in bed"

4. fourth person's answer: "at 10 pm I was still jogging around the corner of the apartment complex."

5. fifth person's answer: "at 10 pm, I was still cooking dinner"


SO, who's the thief ?

oohh i like these...seems like it should be the 4th person but it's not always as things appear i'ma put on my sherlock homie hat on and think of this more intensely..

Well, I don't think so, because the robbery took place at 10pm and the 4th person was jogging at that time, meaning he could be running away from the crime scene?

i don't believe it's that simple. must think more! i must discover who this thief is, my life will not be complete if i don't solve this crime!

I was thinking along the lines of number 2 and 5.  Simply because those two requires the use of electricity because you can't watch tv without power and you can't cook in the dark.

Darkplanetasia was right.. it's the guy who's watching T.V. The #2 guy. At 10:00 P.M. the power was off so how can he watch T.V. when the powers got cut off?
