A longtime investigator with the Merced County District Attorney's Office is facing a misdemeanor DUI charge after a solo vehicle crash Tuesday morning.

According to the California Highway Patrol, Rockie Xiong, 56, crashed a Merced County fleet vehicle he was driving into a guardrail on Ashby Road, near Franklin Road. Xiong was allegedly under the influence of prescription medication, according to the CHP.

CHP Officer Richard Pereira responded to the scene around 8 a.m. after receiving a call about the crash. After Pereira arrived, he went to speak with Xiong, who was standing at the right rear side of the white 2007 Chevy Impala.

Pereira noticed Xiong was having trouble staying awake. The first witness at the scene also reported Xiong was lying face down on the pavement after the crash.

Xiong had been traveling eastbound on Ashby Road when the right side of the car struck the guardrail.

Pereira described Xiong's injuries from the crash as "slight." He said Xiong's inability to stay awake was because of the medication, not injuries suffered from the crash. No one else was injured.

When asked about the medication Xiong had taken, Pereira declined comment. He said a sample of Xiong's blood was taken as part of the investigation. Damage to the fleet vehicle was minor, Pereira said.

Pereira clarified Xiong wasn't under the influence of alcohol or illicit substances. Still, driving under the influence of any drug is illegal.

Xiong was taken to Mercy Medical Center Merced after the crash for examination. He wasn't booked into the Merced County Jail, but will receive a summons to appear in court, Pereira said.

Pat Lunney, chief investigator for the district attorney's office, said Xiong has been placed on administrative leave. Lunney said Xiong informed him he was taking blood pressure medication, which may have caused a negative reaction. "It's an unfortunate situation; however, it's a relief no one was hurt," Lunney said.

Xiong has worked as a welfare fraud investigator for more than 20 years, Lunney said.

I once had to go with my code enforcement coworkers while I was working with the county over to his house because many of his neighbors were complaining that they were fighting roosters in his back yard and that the roosters were making too much noise!   ;D
