Using freedom of religion as a defense
« on: June 17, 2018, 09:16:15 PM »
I think using it as a defense against discrimination every time and anytime can and will lead to people using it for any hate that they have against a particular group. Sometimes those people don't even care about their own religious beliefs. Just like the case with the cake shop. Baking a cake isn't against their religion. But one can argue that by baking a cake the baker is participating in that act. But this is just an excuse to refuse service to gays because they hate homosexuality and/or homosexual. The reason I say this is because they really have no concern for the whole act of an immoral marriage. The bakers are actually choosing to take the risk to sin with every wedding cake they sell. They already acknowledged that participating in an immoral marriage does not affect their religious beliefs. It doesn't matter on their definition of an immoral marriage. So either they don't offer wedding cakes or they have to provide the same service for everyone otherwise they are discriminating against that particular group. You can't have it both ways. It's the same as nonreligious people saying religion can't be the reason for denying a legal marriage license to a gay couple but at the same time want a requirement for churches and priests to perform a ceremonial gay marriage. Again, can't have it both ways. That's why separation of church and state is very important. The best way to have equal religious rights, is to have a secular state.

Example:
Not allowing an official prayer session in public schools will be the best route. If one religion is allowed to have an official school prayer session in public schools, then all religion must be allowed as well even if it means it is offensive to one religion. By not allowing it, you already eliminate any potential of one religion being offended by a different one. You can't demand a session for your religion and deny the session for another. Prayers won't offend religious and nonreligious students. Having no prayer session may offend religious students but not nonreligious students. Having one will offend both religious and nonreligious students.

Trying to prevent a problem before it happens should be the goal instead of waiting for the problem then trying to find the solution to solve it.

i'm in favor of the decision...it will give me the power open up the best pho restaurant and refuse to serve duma.  i will also open a strip club, if duma is not making $20 bills rain, he ain't getting in.  he can't sue me neither because i'm a protected class!  ha!

they provided a case law that one can take advantage of, why not use it! ?
