Woman raped on train as bystanders did nothing, police say

A woman was raped by a stranger on a commuter train in suburban Philadelphia in the presence of other riders who a police official said “should have done something."

Superintendent Timothy Bernhardt of the Upper Darby Police Department said officers were called to the 69th Street terminal around 10 p.m. Wednesday after the assault on the westbound train on the Market-Frankford Line.

An employee of the Southeastern Pennsylvania Transportation Authority who was in the vicinity as the train went past called police to report that “something wasn't right" with a woman aboard the train, Bernhardt said.

SEPTA police waiting at the next stop found the woman and arrested a man. The woman was taken to a hospital.

Bernhardt called the victim an “unbelievably strong woman" who provided police with a lot of information. She did not know her attacker, he said.

“She’s on the mend," Bernhardt said. “Hopefully she will get through this."

The entire episode was captured on surveillance video that showed other people on the train at the time, Bernhardt said.

“There was a lot of people, in my opinion, that should have intervened; somebody should have done something," Bernhardt said. “It speaks to where we are in society; I mean, who would allow something like that to take place? So it’s troubling."

Fiston Ngoy, 35, has been charged with rape, aggravated indecent assault and related counts, according to Delaware County court records. Bernhardt said he is known to both SEPTA and Upper Darby police.

Court documents don't list a defense attorney, and a listed number for him couldn't be found Saturday.

SEPTA issued a statement calling it a “horrendous criminal act" and urging anyone witnessing such a thing to report it to authorities.

“There were other people on the train who witnessed this horrific act, and it may have been stopped sooner if a rider called 911," the authority said.

a lot of people may have been present but did she do anything like scream for help, fight back or try to get away...I would have done nothing neither, if I was under the assumption that they were probably bf/gf getting their freak on in public!

Police do not believe a single witness on the train dialed 911. They are investigating whether some bystanders filmed the assault.

Both the man and woman got on the train at the same stop Wednesday night in North Philadelphia. Officers pulled the man off of the woman at the last stop. They responded within about three minutes of a 911 call from a transportation authority employee, authorities said.

“What we want is everyone to be angry and disgusted and to be resolute about making the system safer,” SEPTA Police Chief Thomas J. Nestel III said at the news conference.

Arrest records show Fiston Ngoy, 35, was charged with rape and related offenses.

The affidavit of arrest for Ngoy detailed times of the assault, including that during those 40 minutes the woman appears to repeatedly push Ngoy away.

Nestel would not give an approximate number of witnesses and it was unclear from the affidavit how many passengers were present for those 40 minutes. Authorities have not released the surveillance video.

“I can tell you that people were holding their phone up in the direction of this woman being attacked,” he said.

Rape on Philadelphia train was horrific, but experts say we're missing something in our outrage

On a train outside Philadelphia last week, police say a woman was harassed, groped and then raped over the course of two dozen train stops while fellow riders watched and did nothing to intervene. Police are investigating whether some passengers recorded the attack on their phones, which authorities say stopped only when a transit officer got on the train, ripped the attacker off the woman and called 911.

It's a horrific case that has many people outraged, prompting questions about why society is so tolerant of gendered violence and how we've become so inured to people's suffering.

"It is a really heartbreaking story. Based on what we know, it seems like there were a number of folks who had an opportunity to make a difference, to take some form of action to get involved, and that those individuals actively chose not to do so," said Laura Palumbo, communications director at the National Sexual Violence Resource Center. "But what we don't know was if they were scared or if they were confused or if they were hoping someone else would take action, which is likely the case. ... It's true that being an active bystander is often not easy, often not straightforwar d."

Police are investigating, and there's much about the incident that remains unknown (whether people were actually recording, whether they were doing it for shock value or to deter the assailant, or what subtle ways they may have tried to stop the attack that didn't involve physical restraint). But even absent all the facts, experts in gendered violence say the incident is an opportunity to emphasize the importance of bystander intervention, not just in cases of assault, but in our everyday lives.

Experts say that for most people, intervening won't look like ripping a stranger off a victim in a public setting but rather challenging a culture that repeatedly minimizes and excuses sexual violence. Intervening includes everything from shutting down a sexist joke to insisting a friend not stay at the party alone to believing the person who tells you someone you admire committed harm.

These are the same people/parent who will run away and abandon their children.

We've all seen the proof on tictok vines youtube of incidents where the scared parent runs away first.  It the same self-preservation mentality in some people.
