Well... at least, Brandon's DEI activist appointee SCJ Jackson seem to think it is. By the way, she's the same SCJ that can't tell what a 'woman' is.
Jackson cited language in the Virginia laws which prohibited an individual from acting in a way that was inconsistent with their nature and compared it to language in the Tennessee law.
“When you look at the structure of that [Tennessee] law, it looks in terms of—that you can’t do something that is inconsistent with your own characteristic s, it’s sort of the same thing,” Jackson said.
She continued by claiming Virginia would have been successful in defending its case if such an argument was permissible by the court.
“It’s interesting to me that we now have this different argument and I wonder if whether Virginia could have gotten away with what they did here by just making a classification argument in the way that Tennessee did in this case.” -NBC
What she's referring to is the landmark '1967 Loving vs Virginia' case where the SCOTUS struck down a Virginia law banning interracial-marriage.
The comment came as the high court weighs the legality of a Tennessee law that bans gender procedures (surgery) for children (as young as 2yrs old) and whether it violates the equal protection clause of the 14th Amendment.
Now, we all know that Mrs. Jackson is a DEI activist appointee (pandering for votes)... and the GOP Senators are fearful of being labeled racist/sexist(female black woman) hence, they approved the appointee.
Don't go claiming that the Lefties/Demmies is all about diversity and the GOP are racist/sexist... since, it was Brandon and 25 Dem Senators that threaten a filibuster if Janice Rogers Brown (the first black female SCJ nominee) was approved by the GOP Senators in 2005.
