In order to win a legal case you must consider how you're charging someone and then have evidence beyond a reasonable doubt to support those charges.
This is why police-involved shooting shouldn't be decided on emotions and too quickly. Much too easy to get them off the hook since the city always allows room for police to use force during arrests and when taking a suspect into custody.
