~black man was caught trespassing, he was likely up to no good but since there was nothing of valuable, he took off.
~a former law enforcement officer witnessed the crime and gave chase with his son to make citizen's arrest
~black man initiated the fight upon being confronted
~and in the struggle the black man was shot...no doubt that both the white man and the black man were fighting for their lives...the white just happens to come out on top.

the person video recording had nothing to do with the shooting. He heard the commotion and followed suit to record.

premeditated is having made a plan and following through with the criminal act. It just don't happen out of the blue like in this case.
